postheadericon Poll: Plurality supports Kagan confirmation

A plurality of Americans want Supreme Court nominee Elena Kagan confirmed to serve on the high court, according to a poll released Tuesday. 

A Gallup survey showed that 44 percent said they would like the Senate to vote in favor of her confirmation, while 34 percent said they wanted the Senate to vote it down, and 22 percent said they had no opinion.

The results nearly match Gallup's survey from May, when Americans favored her confirmation 46-32. 

altThe Senate Judiciary Committee is expected to vote on Kagan's confirmation next week, sending it to the full Senate. 

President Barack Obama's solicitor general is expected to be confirmed to the post. Though she has faced tough questions at her confirmation hearing, the proceedings have generated few front-pa! ge headlines. 

If confirmed, Kagan would be the first Supreme Court nominee to rise to the high court without a majority backing her. Bush nominee Harriet Miers and Reagan nominee Robert Bork both had less than 50 percent support, and both were not confirmed. 

The GOP has criticized Kagan's treatment of military recruiters on Harvard's campus as dean of the law school there and some have said she lacks enough judicial experience to sit on the court. Senate Democrats have said she is right for the job. 

Sixty-eight percent of self-identified Democrats back Kagan's confirmation as opposed to 43 percent of independents and 21 percent of Republicans. Sixty percent of Republicans oppose her.

The poll was taken of 1,020 adults nationally between July 8-11.
